HIPAA for Insurance Producers

Back in 2010 an insurance general agent came to us with the results of a recent HIPAA risk assessment showing that they needed help with their written policies and procedures. Their consultant had recommended Compliance Helper and we began our SaaS process. Within a month they were well on their way to intermal compliance and asked us what to do about their hundreds of producers. The HIPAA Omnibus Rule requires insurance producers to get compliant and general agents and carriers are required to get “satiisfactory assurances” that their producers are compliant in addition to getting them to sign a business associate agreement (BAA) stating that they are compliant.

They also get a monthly task list of compliance tasks that they need to accomplish in order to stay compliant. One of the tasks is to fill out an attestation form which include a HIPAA quiz. The attestation is filed and serves as documentation of their compliance activities. It also is used to calculate their compliance score for the month and their cumulative score which are shown in their Compliance Meter(tm). This can be posted on their website as proof of their on-going compliance to their customers, agents, and carriers.
